SPECIAL COMMUNIQUE TO EMPLOYERS
NATIONAL TRIPARTITE AGREEMENT TO PRO RATE WAGES –
- The Hon. Minister of Labour agreed to extend the National Tripartite Agreement to Pro Rate Wages until the 31st of December 2020, particularly considering the current developments as represented by the Employers’ Federation of Ceylon (EFC). The coverage will be for the period 1st October 2020 until 31st December 2020.
- However, employers in all industries with the exception of the tourism industry – which includes the travel, hospitality, hotels including restaurant sectors – would be required to write to the Commissioner General of Labour (with attention to Mr. Janaka Paranamana, Additional Commissioner General of Labour) informing that they will be implementing the Agreement.
- As such, employers in the tourism industry – travel, hospitality, hotels including restaurant sectors will not be required to inform the Commissioner General of Labour. All others will be required to inform the Commissioner General of Labour citing their requirements.
- As you are aware, employers whose operations/businesses are affected due to the COVID-19 pandemic, either permanently or temporarily, and who are not in a position to offer work to their employers are eligible to apply and pay pro-rated wages on the basis of 50% of the wage or Rs. 14,500/- whichever is higher on the days that they are unable to offer work for reasons mentioned above.
- As in the past, employers are encouraged to rotate employees when offering work in situations where they have not been able to operate at full capacity due to the implications of the pandemic and as a result have not been able to deploy their full cardre of workers.
- Employees and Trade Unions who represent them will retain the right to furnish any grievance directly to the Commissioner General of Labour for redress.
