NATIONAL TRIPARTITE AGREEMENT TO PRO RATE WAGES


  1.  Based on representations made to simplify the process for industries other than the tourism industry (which has been given blanket coverage) in applying the scheme and considering the practicalities of implementation, the Hon. Minister of Labour pronounced the following.

Extracts of minutes of the Ministerial Level Force Meeting on impacts of COVID -19 on Employment held on 16th November that relate to the process to be followed when implementing the National Tri-partite Agreement to pro-rate wages.

        1. Hon. Minister summarized the decision.

Employers, who intend to use this agreement, are required to inform to DOL and subsequently submit information including details of workers in respect of

whom this agreement was applied to the DOL, at the end of the month. CGL will circulate those details among Task Force members and convene meetings on weekly basis if details are contested by trade unions.

a)Accordingly, employers in all industries with the exception of the tourism industry (which includes the travel, hospitality, hotels including restaurant sectors) would be required to inform the Commissioner General of Labour in writing that they will be implementing the Agreement.

 

b)They would be required to submit the salary payment details of employees in respect of whom the Agreement was implemented every month at the end of the salary payment cycle.

As such, the internal process of granting approvals by the Commissioner General of Labour after inquiries made will not take place.

c)Employers who wish to implement the scheme are requested to strictly follow the foregoing procedure.

  1. Employees and trade unions who represent them will reserve the right to furnish any grievance directly to the Commissioner General of Labour for redress.  The Commissioner General of Labour is empowered to convene meetings of the ‘Dispute Committee’ to expeditiously address any grievance brought to his attention.
  2. The above communique is issued for the benefit of all employers considering the importance of the issue nationally and the numerous requests received from employers other than members regarding the implementation of this scheme.
